Terms of service

Please read these terms carefully. By creating an account you confirm that you have read, understood and agreed to them.

1. Who we are

TaxPilot CH, based in Basel, Switzerland (no fixed office address; contact: hello@taxespilot.ch, hereafter “TaxPilot”, “we”) provides a software tool that helps Swiss residents prepare their annual tax return. By using the service you (“the user”) accept these terms.

2. What the service is — and is not

TaxPilot is a tax preparation assistant. It scans documents, suggests possible deductions, organises records and produces a draft summary you can review and import into the official cantonal tax software.

TaxPilot is not a licensed tax advisor, fiduciary, lawyer or auditor. It does not file your tax return on your behalf and does not provide individual tax advice. For complex situations (international assets, business income, inheritance, divorce, etc.) you should consult a qualified Swiss tax professional.

3. Your responsibility for the final return

The final accuracy, completeness, signature and submission of your tax return are your sole responsibility. You must review every figure before importing or submitting it to the cantonal tax office. By using the service you expressly acknowledge that:

  • You are responsible for providing complete and truthful information.
  • You must verify every suggested deduction against your own documents and Swiss tax law.
  • You remain liable to the tax authorities for the content of your declaration.

4. Disclaimer of warranties

The service is provided “as is” and “as available”. To the maximum extent permitted by Swiss law, TaxPilot disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of calculations, completeness of deductions, and uninterrupted availability.

Tax law and cantonal practice change frequently. We do our best to keep the tool up-to-date, but we make no guarantee that any specific calculation, deduction or import file is correct for your individual situation.

5. Limitation of liability

To the maximum extent permitted by Swiss law, TaxPilot, its directors, employees and sub-processors are not liable for:

  • Tax assessments, back-taxes, penalties, interest, fines or late fees imposed by any tax authority;
  • Missed deductions, allowances or refunds;
  • Errors caused by inaccurate, incomplete or outdated information provided by the user;
  • Indirect, incidental, consequential or punitive damages, lost profits or lost data;
  • Service interruptions, downtime, or failures of third-party services (cantonal portals, banks, OCR providers).

Where liability cannot be excluded by law, our total aggregate liability for any claim is limited to the fees you actually paid to TaxPilot in the 12 months preceding the event giving rise to the claim.

6. Account & acceptable use

  • You must be at least 18 years old and a Swiss tax resident or cross-border worker.
  • You are responsible for keeping your credentials and 2FA secret.
  • You may not upload malware, attempt to breach our security, reverse-engineer the service or use it to prepare fraudulent declarations.
  • We may suspend or terminate accounts that violate these terms or applicable law.

7. Fees, billing & refunds

Prices and what is included in each plan are shown on the pricing page. Payments are processed by our payment provider. Annual plans are billed once a year; you can cancel at any time and keep access until the end of the paid period. Refunds are handled on a case-by-case basis if the service did not deliver the documented features.

8. Intellectual property

The software, design and content of TaxPilot remain our exclusive property. You keep full ownership of every document and piece of data you upload. We only process them to provide the service to you.

9. Data protection

Our handling of personal data is governed by the privacy notice, which forms an integral part of these terms.

10. Changes

We may update these terms to reflect changes to the service or to Swiss law. Material changes will be notified in-app and by email at least 30 days before they take effect. Continued use after that date counts as acceptance.

11. Governing law & jurisdiction

These terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on the International Sale of Goods (CISG). The exclusive place of jurisdiction is Basel-Stadt, Switzerland, subject to any mandatory consumer-protection rules in your canton of residence.
